Whenever at least 20 percentum of the families <br /> ! and unrelated individuals residing in a county or <br /> multicounty unit have incomes below the poverty level <br /> or index, (such findings must be based on the most <br /> recent census or survey conducted by the Bureau of <br /> Census), the size of the total population of such <br /> units may not alone be the basis for granting (or <br /> denying) eligibi ity to such units seeking to be <br /> served by a community action agency. <br /> On the other hand, the amended Section 210(c) does <br /> not prohibit the use of population size as a cri- <br /> terion for eligibility when it is used in conjunc- <br /> tion with other compelling conditions provided in the <br /> law. Thus, under the amended law, a new CAA may not <br /> be designated in county or multicounty units if the <br /> unit 1) has a population of less than 50,000; 2) was <br /> served by an existing CAR on June 1, 1978; and 3) the <br /> new CAA would serve a sm. 11er geographical area than <br /> that served by an existing CAA on June 1, 1978. It <br /> should be noted that all three of the above conditions .� <br /> must be evident for denial of eligibility. The effect <br /> of the new Section 210(c) language is such that if <br /> the applicant unit can satisfy criteria 2) and 3) de- : <br /> nial of eligibility could not be decided solely an the <br /> applicant's failure to satisfy the criterion related <br /> to population size. <br /> CSA is amending its regulation on the eligibility and <br /> establishment of coy munity action agencies (CSA Instruc- <br /> tion 6400-02) to reflect this change. <br /> B.
