Mr. Freeman brought to the Board' s attention violations by the Easb <br /> 6. Office Park of the County' s Ordinance to Provide for the Control of Soil. <br /> 7. Erosion and Se imentation. Areas of the Ordinance violated are Section ; <br /> 8 - Subsection a) : Buffer Zone Requirements, Subsection c) : Ground Cover Re( <br /> 9. meats, and Sub ection d) : Design and Performance of Control, Measure . M) <br /> 10. Freeman stated Eastowne Office Park had failed to implement an approved <br /> 11 . erosion and se imentation plan, had failed to maintain temporary sedimen# <br /> 12• controls, fail d to control erosion from disturbed areas within a reasone <br /> 13. length of time failed to take effective corrective actions by given dead <br /> 14 . lines, and failed to submit requested status reports on project by deadli <br /> 15. Neither the construction supervisorm the architect, nor the owner of the <br /> 16. project had re ponded to numerous warning letters which have been sent. <br /> 17. The Count Attorney informed the Board that according to Section 22 <br /> 18 . Penalties of ti Ordinance, the County Commissioner must determine an amo <br /> 19 - of the civil penalty and make a demand for payment. If payment is not ma <br /> 20 • within sixty days, then the County would go to Court. Section 23 of the <br /> 21- Ordinance speak of .Injunctive Relief. As the Governing Body, the County <br /> 22 . Commissioners m st make a determination as to whether there is reasonable <br /> 23. cause to believa the Ordinance has been violated. <br /> 24 • Mr. Gledhill stated if the Board so desired, immediate action in the <br /> 25 . form of Injunct ve Relief can be initiated. While this action is pending <br /> for civil penalty <br /> 26 - wait out the si ty days, and if payment'&is not received, the County Attorr <br /> 27. will continue with going to Court. <br /> 28 . Discussion ensued. Commissioner Gustaveson stated he felt the County <br /> 29. should show signs that they intend to enforce the Ordinance and should the <br /> 30. fore seek civil penalties as well as injuctive relief. <br /> Commissioner Pinnev R-FAi-c A iii, ti.,=�- <br />
