EXECUTIVE SESSION <br /> 1. <br /> January 23, 1978 <br /> 2. <br /> • 3. The County Attorney informed the Board that they needed to resolve tc <br /> 4. provide a defense for each individual Commissioner, and to indemnify in the <br /> 5- event there is any judgment against any Commissioner . Mr. Gledhill stated <br /> I6 • that he had bee in touch with the Great American Insurance Company, and <br /> 7. according to the Regional Claims Manager and the investigator for the <br /> 8 . Insurance Compa�y, the policy the County is covered under is not an error <br /> 9 . and omissions pe'olicy, but a property damage liability policy. The Insurar, <br /> 10 . Company has alrad Y obtain counsel to handl e th is case <br /> and will not honor <br /> 11. the request of the County Attorney' s law firm to represent the County. <br /> 12. The County Attorney will stay in touch and mbhtor the situation for the <br /> 13. County. <br /> 14. Commissioner Pinney raised the question of why the County was not <br /> 15. covered, when it had paid money for a policy. <br /> 16. Mr. Gledhill stated that the people from whom the policy was purchase <br /> 17. are not aliens f I r the company that writes the policy, and for that reason <br /> 18. their failure t acquire this coverage is not something by which the Compa <br /> 19. can be bound. Any action the Board wishes to take against any insurance <br /> 20 . company should b e against Collier and Cobb. <br /> 21 . Mr. Gledhil stated that in his opinion the County could not be liabl, <br /> 22 . in excess of $25 ,000. The County Commissioners are covered under the <br /> 23. County's liability policy with Great American Insurance Company up to <br /> 24 . $250,000 for pro erty damage. This is the policy that is responding to <br /> 25 . the suit. <br /> 26 . Mr. Gledhill stated that the resolution which he presented to the Boa= <br /> 27. gave to the Coun y Attorney specific authorization to defend the Commis-- <br /> 28. sioners in this .litigation, and to make sure that action taken in the suit <br /> 29. happens within t e limits of the policy. <br /> 30. The Commissioners then reconvened into regular session. <br />
