I Page 2 <br /> . <br /> 2. The second matter brought before the Board was in relation to the <br /> 3. Cavil Action bung brought against members of the Board of Commissioners <br /> 4 . by members of the Lake Forrest Association. The County Attorney stated <br /> 5• that he plans t check with Collier and Cobb insurance Company as to <br /> 6 . whether or not he members of the Board of Commissioners are covered by <br /> 7. the Errors and i,mmissions Insurance. If there is coverage, the Insurance <br /> 8- Company will to e care of providing a defense -for the Board and would cavE <br /> 9 . the cost aspect of the suit. Mr . Gledhill stated that the only allegation <br /> 10. which dealt dir ctly with Orange County, speak of things which the County <br /> 11 . has not done. He added that Governments cannot be held liable for not <br /> 12 . doing things th y- should do but -can be liable for things done incorrectly. <br /> 13. IF the County h�s committed some negligent act, the Count y could be liable <br /> 14 . for the cost. (e stated that under the present North CArolina laws he <br /> 15 . did not feel th t Orange County could be held liable for the damages , exce <br /> 16 . that which speaks of the County Sedimentation Ordinance. It is therefore , <br /> 17 . important to enforce the County Ordinance. <br /> 18. The County Attorney's Office will represent members of the Board of <br /> 19 . Commissioners I this court action. <br /> 20. Mr. Gledhill stated that it is important that all members of the <br /> 21.
