Ronald Aycock, Executive Director and General. <br /> Counsel and Butch Gunnells , Counsel for Intergovern- <br /> mental Affairs <br /> DATE: November 14, 1977 <br /> RE: County Enforcement of New Insulation and Energy <br /> Conservation Standards in the State Building Code <br /> The 1977 General Assembly enacted two laws which make counties <br /> and municipalities responsible for enforcement of new provisions <br /> in the State Building Code requiring insulation and efficient <br /> energy utilization in buildings. Enforcement of these new <br /> energy conservation standards is required, whether or not the <br /> county currently enforces other portions n t e 5tat� Building <br /> Code. <br /> Chapter 703 of the 1977 Session Laws �ge ��unty and <br /> Flty to �ignate by Septe mberll977 the person( <br /> responsible for enforcing these newly enacted energy conserva- <br /> tion standards in the State Building Code. In each county which <br /> already has an inspection department, the superintendent makes <br /> the designation. In each county without an inspection d p art <br /> ment, the board of county commissioners designates one or more <br /> "'energy and insulation inspectors" and notifies the State <br /> Department. of Insurance as to the selection. Chapter 703 <br /> further provides that, on and after January l; 1978, no person, <br /> firm, or corporation may for a consideration install any <br /> insulation or other energy coniservation materials or equipment <br /> intended to meet the State Building requirements until a rmit <br /> has been secured from the designated county or eft—y enforcement <br /> j „official. This law also provides that a permit can be issued <br /> { only to a licensed contractor or to the holder of an annual <br /> license issued by the county or city with jurisdiction over the <br /> site. <br /> A separate law, Cha ter 792 , sec. 7 of the 1.977 Session Laws, <br /> provides that on <br /> and 3anuary 1, 19782 no new residential <br /> building shall be occupied until it has-.-been certified as being <br /> in compliance with the :Minimum insulation standards for <br /> residential construction enacted in the State Building Code. <br /> Additionally, no electric service is to be supplied to the <br /> occupant of any such new residential building until the building <br /> has been certified, by a ep xson- designa as the count or <br /> OVER <br />
