The Honora le Members of the North Carolina Board of Transportation <br /> Page 4 <br /> September 1 , 1977 <br /> State agencies and other parties .. <br /> b) The public hearing notice announcing the hearing of <br /> June 29 , 1976 made mention of the intention to compil( <br /> an "official transcript" from the hearing. <br /> c) Some forty-two (42) speakers did speak, some at lengtl <br /> and others briefly, but all spoke under the impressioi <br /> that their remarks were being recorded in public and <br /> verbatim for the official transcript which was the <br /> clear intent and purpose of the hearing:. <br /> d) In fact, some nine (9) speakers including portions of <br /> opening remarks intended to record the purpose of the <br /> meeting were either not recorded at all or recorded <br /> in part.. <br /> e) The Department of Transportation did not inform the <br /> public and has to date effectively seen fit to hide <br /> from the public the loss of the portions of the tape <br /> related to the nine speakers . <br /> (f) From the viewpoint of the 1-40 opposition, at least sc <br /> of the lost recordings are traceable to significant ar. <br /> substantive matters of opposition that were not, thoug <br /> stated publi.cl.y, recorded as intended and required. <br /> (g) :Included among the significant lost recordings were <br /> those of the Moderator , three attorneys representing <br /> various interests , a leader of a prominent environment <br /> group , the Superintendent of the Durham County Schools <br /> and the Chairperson of the Orange County Board of <br /> Commissioners. <br /> ( ) rose speakers whose comments were lost were apparentl <br /> l individually notified even though the public at <br /> large has never been so notified. Such speakers were <br /> given an opportunity to add comments over an extended <br /> period of time not afforded members of the general. <br /> public. <br /> I point out to each of you the tremendous importance of the very <br /> limited re�ztfining undeveloped land area between Durham and Chapel Hit <br /> to the Tutu e of Orange County, Duke University and the University of <br /> North Carolina. An interstate concrete strip with all of the atten.da <br /> motels , fil ing stations and the like between these two great campuse <br /> would unque tionabl.y not only set up a psychological barrier, introdu <br /> noise , heat and pollution, but would absolutely in time destroy any <br /> opportunity for the healthy and controlled growth and land use planni <br /> now envisioned. <br />
