�i <br /> 2.3.5.4 Nothing in this section shall be construed to authorize the <br /> Board to permit a use in a district where that use is neither <br /> a Permitted Use nor a Special Ilse. <br /> 2.3.6 Application of Spacial Use Power <br /> 2.3.6.1 Before any"application for a Special Use shall be approved, <br /> the Board shall make written findings certifying compliance with <br /> the specific rules governing each individual special Use and <br /> that satisfactory provision and arrangement has been made <br /> concerning the following, where applicable: <br /> a) The use will promote the public health, safety and general <br /> welfare, if located where proposed and developed and op_rated <br /> according to the plan as submitted; <br /> b) The use, which is l.iste'dras a Special. Use in the district in <br /> which it is proposed to be located, complies with all required <br /> regulations and standards, including the provisions of Article <br /> 5 and 6 of this ordinance, unless greater or different regula- <br /> tions are contai.ned.i.n the individual standards for the specific <br /> Special Use; <br /> c) That the use will maintain or enhance the value of contiguous <br /> Property, or that the use is a public necessity; <br /> d) That the use is in compliance with the general plans for the <br /> physical development of the County as embodied in these reg- <br /> ulations or in the Comprehensive Plan, or portion thereof, <br /> adopted by the Board of County Commissioners. <br /> 2.3.6.2 The Board may impose reasonable conditions upon the installation <br /> and operation of any Special. Use to insure that the public health, <br /> safety and general welfare shall be protected and substantial <br /> justice done. <br /> 2.3.7 Application of Interpretation Power <br /> 2.3.7.1 An appeal from an order, requirement, decision or determina- <br /> tion of the Zoning officer shall be decided by the Beard, <br /> ( based upon its findings of fact and to achieve the intent of the <br /> i ordinance. in exercising this power, the Board shall act in a <br /> prudent manner so that the purposes of the ordinance shall be <br /> served. The effect of the decision shall not be to vary the <br /> terms of the ordinance nor add to the list of Permitted Uses <br /> i in the districts. <br /> f <br /> 2.12 <br /> `i <br /> { <br /> i 1 <br />
