NON-CONFOPMTTIES <br /> 11.1 Definition <br /> Non--conformities are classified as: <br /> a) Lots; <br /> b) Uses of land without structures or minor structures only; <br /> C) Uses of major structures and premises; <br /> d) Structures; and <br /> e? Characteristics of use which were lawful but would be prohibited• <br /> regulated or restricted by the enactment of <br /> subsequent amendment thereto.' : <br /> Non-conformity may also bel ffecct t s <br /> created where lawful public g <br /> or actions pursuant to.a court order have the same e a as <br /> violations of this ordinance, if undertaken privately. <br /> 11.2 Intent Concernin Non-conformities Generally <br /> Uses of land which do not conform to the requirement of this or- <br /> dinance or amendments to it may not be enlarged or expanded; <br /> neither shall the use be intensified, nor altered, except in <br /> conformance with this ordinance. <br /> It is further the intent of this ordinance that non-conformity <br /> shall not be used as grounds for adding other prohibited uses <br /> or structures, nor the enlarging by means of extension or ex- <br /> pansion, except as specifically provided by this ordinance. <br /> 11.3 Cancer Intent Cernin Nqn-Conformin Uses: 5 ecificall I]eclared <br /> To Intent title With permitted Uses <br /> It is the intent of this ordinance that non-conforming uses shall <br /> be considered to be incompatible with the permitted Usenot bthin <br /> the several districts. Such non-conforming uses shall <br /> enlarged or extended in any respect. <br /> 11,A 5 ecial Permit Uses Not To Be Considered Non-Conforming <br /> Any existing use which would require a special Use permit under <br /> terms of this ordinance shall be deemed a conforming use. How- <br /> ever, enlargement, replacement or modification of such a use shall <br /> require a Special Use Permit as though it were a new use. <br /> ?3�1 <br />
