TO HAVE AND TO HOLD said real property together with all improvements thereon, and all privileges and appurtenances thereto - unto belonging to the Chapel. Hill Housing Authority, its successors and assigns, subject however to the following conditio s_ 1. The above described tract shall be used by the Chapel. Hill. Housing Authority for Housing Authority purposes. In the event the Chapel Hill Housing Authority ceases to exist, its interest in the above described tract may be transferred to a governmental successor provided the governmental successor operates housing authority programs or functions in the same manner as the Chapel Hill Housing Authority on a county-wide basis; its services and functions to be made available to all of the citizens of Orange County. 2. The above described tract of land shall be developed for Housing Authority purposes within three (3) years. 3. The above described tract of land shall not be used for private development. 4. in the event that the Chapel Hill Housing Authority or its governmental successors performing the functions now performed by the Authority should choose to divest: itself of said tract of land within fifty (50) years from the date of this deed, the Chapel Hill Housing Authority or its successor shall without charge or the payment of any sum, convey said property to Orange County unless Orange County shall give written notice to the Chapel Hill Housing Authority that it does not desire to have said property transferred to it.
