4 <br />(c) As to the adequacy of evidence on unifzed control and the suitability of any proposed <br />agreements, contracts, deed restrictions, sureties, dedications, contributions, guarantees, or <br />other instruments, or the need for such instruments, or for amendments in those proposed; <br />For purposes of the SUP application, staff makes the following findings with regard to the <br />request: <br />i. That the rezoning and SUP application contains sufficient documentation <br />indicating that the development will be under unified control guaranteeing the <br />development of the property consistent with the proposed rezoning and SUP <br />application. <br />On making an affirmative finding, with respect to these three (3) requirements, staff relied on <br />the following information: <br />a. The Bucl~liorn Village Economic Development Planned Development application, <br />prepared by Summit Consulting and Scott T. Murray Incorporated, outlining the <br />nature of the project, <br />b. The sworn testimony, as outlined within the minutes of the QUARTERLY <br />PUBLIC HEARINGS, dated February 25, 2008 and April 1, 2008 of: <br />i. The applicants, namely: Rosemary Waldorf, Roger Perry, and George Horton <br />ii. The consultants, namely: <br />1. Swnmit Consulting Firm (Jim Parker, Tracy Parrott) <br />2. Scott T. Murray Incorporated (Scott Murray) <br />3. Gel Group -Environmental Consultants (Bob Miller) <br />4. Arcadis -Traffic Engineering Firm (Tyson Graves) <br />iii. Planning staff, <br />iv. The Board of County Commissioners and the Planning Board, and <br />v. Members of the general public, <br />c. The applicant's response to questions asked during the PUBLIC HEAIEZINGS <br />dated March 19, 2008 and April 30, 2008, <br />d. The Orange County Zoning Ordinance, <br />e. The Orange County Economic Development Design Manual, and <br />f.
