2 <br />STAFF BACKGROUN~I AND COMMENT: C <br />As you are already aware from previous correspondence, Buckliorn Road Associates LLC (hereafter <br />`applicant') has submitted an application proposing the development of a phased, unified <br />commercial center on several parcels of property along Buckhorn Road. <br />The project is classified as a Planned Development due to the following conditions specific to the <br />proposal: <br />1. The project is proposed to be under unified control and to be planned and developed as a <br />whole;: <br />Staff Comment: This requirement is outlined within Section 7.2 (a) of the Ordinance <br />2. The development is proposed to be developed as a single development, including the <br />installation of all necessary infrastructure, for all of the property referenced for the project; <br />Staff Comment: This requirement is outlined within Section 7.2 (b) of the Ordinance <br />3. The application indicates that the provision, operation and maintenance of landscaped and <br />open space areas, parking facilities, individual buildings, and street/sidewalk improvements <br />will be for common use by the occupants of the district and will not be maintained at general <br />public expense; <br />Staff Comment: This requirement is outlined within Section 7.2 (e) of the Ordinance <br />4. The proposed use of property is required to be reviewed and approved as a Planned <br />Development in accordance with Section 2.2 Table of Permitted Uses of the Orange County <br />Economic Development District Design Manual; and <br />5. The applicant has requested to deviate from specific provisions of the Orange County <br />Economic Development District Design Manual, specifically proposing fourteen (14) design <br />solutions that replace existing regulatory standards. <br />Staff Comment: This requirement is detailed within Section 7.21.1 PD-ED District: <br />Definition and Intent. of the Ordinance. <br />Ultimately, this project is a Planned Development due to: <br />1. The applicant's desire to deviate from fourteen (14) of the individual design standards <br />established within the Economic Development Design Manual <br />As a result a Planned Development application is required per ;Section 7.21.1 of the <br />Ordinance, <br />2. The Table of Permitted Uses of the Economic Development Design Manual defines the <br />proposed use as a Planned Development project, specifically: `Retail trade, sales and Mental <br />of durable and convenience goods, merchandise, and equipment, including mail ordeY <br />houses, in a separate, free-standing building'. <br /> <br />
