1 <br />ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />ACTION AGENDA ITEM ABSTRACT <br />Meeting Date: June 3, 2008 <br />Action Agenda <br />Item No. ~- - ~ <br />SUBJECT: Contract Award, Construction Manager at Risk Services, Animal Services <br />Facility Phase II--Building <br />DEPARTMENT: Purchasing PUBLIC HEARING: (Y/N) No <br />ATTACHMENT(S): INFORMATION CONTACT: <br />Pam Jones, 919-245-2652 <br />Cost Breakdown of Phase II (Building <br />Construction) <br />PURPOSE: To consider approval of an amendment to the Contract with Clancy &Theys as <br />Orange County's Construction Manager at Risk ("CMAR") for the construction of the Phase II- <br />Building package for the Orange County Animal Services Facility. <br />BACKGROUND: On June 12, 2007, the Board approved the project scope and final design <br />for the Animal Services Facility to be located on Eubanks Road. On October 9, 2007, the Board <br />approved Clancy &Theys as the CMAR for this project, thereby allowing them to work with the <br />Project Team on iterative pricing and value engineering exercises and to solicit bids in <br />anticipation of a final Guaranteed Maximum Price for Board approval. <br />Since the September inclusion of the CMAR to the project, the Project Team consisting of Dixon <br />Weinstein Architects (DW) and their sub-consultants, including Animal Arts (AA) - a Colorado <br />architectural firm specializing in the design of animal facilities, Clancy &Theys (CT), the County <br />staff, the County Attorney, and the County's contract construction manager have worked <br />through several iterative value engineering exercises and have continued to work through the <br />Town of Chapel Hill's regulatory approval process. <br />Because of the urgency to complete the Project by the end of 2008, the Board approved the <br />CMAR Contract for site work (Phase I) on February 19, 2008. That phase of the Project is <br />underway. <br />The Contract for which approval is being sought will allow the CMAR to continue with the <br />building portion of the Project once the site work is complete. This contracting structure will <br />,allow the Project to remain on track for the substantial completion target date of December 31, <br />2008 as agreed to between the County and the University. <br />FINANCIAL IMPACT: The Guaranteed Maximum Price ("GMP") for construction of the facility <br />(Phase II) is $6,045,767. The Board will recall that an earlier contract in the amount of <br />$1,308,733 was awarded for the site work (Phase I of the project). The total GMP for <br />constructing the project equals $7,354,500. A breakout of the Phase II costs is attached and will <br />
