9 <br /> Attachment 2 <br /> STATEMENT OF CONSISTENCY <br /> OF A PROPOSED UNIFIED DEVELOPMENT ORDINANCE TEXT AMENDMENT <br /> WITH THE ADOPTED ORANGE COUNTY 2030 COMPREHENSIVE PLAN <br /> Orange County has initiated an amendment to the Unified Development Ordinance <br /> (UDO) to allowing for the modification of established impervious surface limits with the <br /> installation and perpetual maintenance of an infiltration based stormwater feature commonly <br /> referred to as a Best Management Practice (BMP). <br /> The Board of County Commissioners finds: <br /> a. The requirements of Section 2.8 of the UDO have been deemed complete; and, <br /> b. Pursuant to Sections 1.1.5, and 1.1.7 of the UDO and to Section 153A-341 of the <br /> North Carolina General Statutes, the Board finds sufficient documentation within <br /> the record denoting that the amendment is consistent with the adopted 2030 <br /> Comprehensive Plan, as amended, or part thereof including but not limited to, the <br /> following: <br /> Chapter 5 — Land Use Element— Section 5.6 Goals— Land Use Goal 1: <br /> Fiscally and environmentally responsible, sustainable growth, consistent with <br /> the provision of adequate services and facilities and a high quality of life. <br /> Chapter 5 — Land Use Element— Section 5.6 Goals— Land Use Goal 6: <br /> A land use planning process that is transparent, fair, open, efficient, and <br /> responsive. <br /> Chapter 6 — Natural and Cultural Systems Element — Section 6.4.4 Natural <br /> Areas, Wildlife, and Prime Forests— Natural Area Obiective 4: <br /> Encourage adequate stormwater runoff controls in existing developed areas <br /> and require these controls for new subdivisions to protect sensitive <br /> downstream aquatic habitat. <br /> Chapter 8 — Services and Facilities Element — Section 8.4.2 Erosin Control and <br /> Stormwater Management— Erosion Control Obiective I <br /> Continue to use Best Management Practices (BMPs) for stormwater control, <br /> as outlined within the Orange County Unified Development Ordinance, <br /> Stormwater Ordinance, and Sedimentation Control Ordinance, to minimize <br /> potential adverse impacts on the water quality. <br /> c. The amendment is consistent with applicable plans because it- <br /> 1. Allows for the placement of additional impervious surface area on a parcel <br /> of property through the installation and perpetual maintenance of an <br /> infiltration based stormwater feature. This feature, required to be designed <br /> by an engineer, will capture and `treat' runoff rather than direct it into <br /> existing streams, waterbodies, or ditches thereby helping minimize the <br /> potential adverse impacts on water quality. <br /> 1 <br />
