38 <br />fifteen X15) days before the expiration of the insurance that such policies are to <br />renew or replace. <br />Before construction of a permitted facility is initiated, but in no case later than <br />fifteen (15) days prior to the grant of the building permit, the holder of the Special <br />Use Permit shall deliver to the County a copy of each of the policies or certificates <br />representincLthe insurance in the required amounts. A Certificate of Insurance <br />that states that it is for informational purposes only and does not confer rights <br />upon the County shall not be deemed to comply with this Section. <br />Pe4RT III. That Article Twenty-two (22) Definitions be amended by creating a new Section <br />entitles Definitions -Telecommunication Facilities to read as follows: <br />Deftnitions -Telecommunication Facilities: The following terms concerning <br />telecommunication wireless support structures as contained within Article 6 and <br />Article 8 of this Ordinance shall be defined as follows: <br />Accessory Use - A use incidental to, subordinate to, and subservient to the <br />principal use of the property. As defined in this section an accessory use is a <br />secondary use. <br />Antenna A system of electrical conductor communications equipment that <br />transmits and/or receives electromagnetic radio signals used in the provision of all <br />types of wireless communications services. <br />Applicant -Any wireless service provider or wireless support structure owner <br />submitting an application for a wireless facility. <br />Application - A formal request, containing all necessary and required <br />documentation, submitted to Orange County to construct or modify a wireless <br />support structure or a wireless facility. <br />Board -The Orange County Board of County Commissioners. <br />Building Code -The most recently adopted or amended edition of the North <br />Carolina State Building Code. <br />Building permit - An official Orange County administrative authorization to begin <br />construction consistent with the provisions of G.S. 153A-357. <br />Collocation -The installation of new wireless facilities on previously approved <br />structures, including wireless support structures, buildings, utility poles, and water <br />tanks. <br />Commercial Impracticability or Commercially Impracticable -The inability to <br />perform an act on terms that are reasonable in commerce; the cause or <br />occurrence of which could not have been reasonably anticipated or foreseen and <br />that jeopardizes the financial efficacy of the project.
