i <br />MEMORANDUM <br />V -2 -87 ORANGE COUNTY HABITAT FOR HUMANITY <br />WEST SIDE OF JO MAC ROAD (SR 1103) ON <br />GEMENA ROAD (PRIVATE) <br />MAY 28, 1987 PAGE 2 <br />LAND USE PLAN: The Land Use Plan designates the area as <br />Rural Buffer. The Rural Buffer designa- <br />tion provides for land adjacent to urban <br />and /or transition areas which is rural in <br />character and should remain rural, <br />contain very low density residential <br />uses, and not require urban services <br />during the present Land Use Plan period. <br />PP T 0 <br />A variance may be allowed only by the Board of Adjustment in <br />cases involving practical difficulties or unnecessary hard- <br />ships, when substantial evidence In the official record of <br />the application supports all the following findings. <br />a) That the alleged hardships or practical difficul- <br />ties are unique and singular as regards to the <br />property of the person requesting the variance and <br />are not those suffered in common with other pro- <br />perty similarly located. <br />FINDING <br />Yes No <br />Staff Comment: The initial approved subdivision of the <br />existing lots left these areas between that <br />are less than 2 acres in size. <br />b) That the alleged hardships and practical difficul- <br />ties, which -will result from failure to grant the <br />variance, extend to the inability to use the land <br />In question for any use in conformity with the <br />provision of this ordinance and include substan- <br />tially more than mere inconvenience and inability <br />to attain a higher financial return. The alleged <br />hardships cannot have resulted from the action or <br />inaction of the applicant. <br />FINDING <br />Yes No <br />Staff Comment: The alleged hardships and difficulties, which <br />will result from failure to grant the <br />variance do not extend to the inability to <br />use the land since it is possible to create 2 <br />acre size parcels. The alleged hardship did <br />not result from the action or inaction of the <br />-16 _L <br />
