Box 161 Carrboro, NC 27510 <br />VARIANCE REQUEST <br />Habitat for Humanity of Orange County, Inc. <br />Chestnut Oaks Subdivision <br />Factors Relevant to the Issuance of a Variance: <br />15r <br />(a) (1) The two "orphan" lots, labeled proposed lots #4 and #5 in the <br />attached plan, are surrounded by existing lots of record and Gemena <br />Road. Property to the rear is in separate ownership. The area <br />across Gemena Road is proposed community space for the entire <br />subdivision. Under the new 2 -acre zoning, the two proposed lots <br />would be unusable. <br />(a) (2) The variance is requested due to the unusual pattern of land <br />subdivision which occurred prior to the County's adoption of 2 -acre <br />zonin in the rural buffer. Habitat for Humanity of Orange County, <br />Inc. ? "Habitat "), a non - profit organization providing low- income <br />housing, subdivided its property into four parcels under the <br />County's procedure for minor subdivisions under the former 40,000 <br />square feet zoning. Habitat permitted the first three families <br />selected for housing to choose the site for their future homes from <br />a total of nine prospective sites (the maximum amount of subdivision <br />permitted before a major subdivision process must be followed). <br />Habitat assumed it would record the additional lots at a later date, <br />but is prevented from doing so by the newer zoning. Habitat does <br />not seek approval for all its previously planned homesites through <br />this variance, just the two which would otherwise be unbuildable. <br />Although some other landowners may be similarly situated, the number <br />is certainly small. <br />(a) (3) The subdivision pattern was established by working with those <br />low- income families who would help build and then occupy the momes <br />and occurred while the sites'.zoning allowed minimum lot sizes of <br />40,000 square feet. <br />(b) Continued development in the Chestnut Oaks subdivision will conform <br />to the newer zoning. Habitat wishes to delay developing plans for <br />cluster development of the entire site until studies of land use in <br />the area and the work of the County task force on low- income housing <br />have been completed, since development plans could be affected. The <br />proposed variance will permit Habitat to continue building some <br />low- income housing during this period: <br />(c) If the variance is denied, the public will sacrifice a major.benefit <br />-- two homes for low- income families -- in order to secure a minor <br />benefit -- two undeveloped parcels in the rural buffer. Habitat <br />believes the housing benefits substantially outweigh the impacts on <br />the rural buffer, particularly since a large proportion of the <br />subdivision will be in open space. <br />
