Richie's Woods - Preliminary Plat <br />(Little River Township) <br />Presentation by Kirk. <br />The property in question is located in Little River <br />Township on Kim's Drive, a private Class B road leading <br />to Pearson Road (SR 1544). The developer is proposing <br />to divide a 10.72 acre tract. creating one new lot. <br />The property is not zoned and designated Agricultural <br />Residential in the Land Use Plan. All applicable <br />agencies have reviewed and commented on the <br />application. <br />Approval of the Preliminary Plan subject to the <br />following conditions: <br />1. Provision of a landscape plan demonstrating <br />compliance with Section IV -B -8 of the Subdivision <br />Regulations, including location of existing trees, <br />land use buffers and areas to be planted. <br />2. Payment -in -lieu of dedication of recreation /open <br />space in the amount of $729. <br />To adhere to time limits in the Subdivision Ordinance <br />the Planning Board must act on this by June 19, 1987. <br />Kirk stated that the payment -in -lieu was not applicable <br />as this project is not in the Joint Planning Area. <br />Jacobs asked how many lots had access to the private <br />road. Kirk responded seven other lots. Jacobs con- <br />tinued that if the adjoining lots in question did have <br />access, the road would have to be upgraded to a public <br />road. <br />Kirk informed the Board that the lots were originally <br />platted at over ten acre lots; thus, the road would not <br />meet the density requirement of NCDOT for a state <br />maintained road. Jacobs responded that the County <br />Attorney had indicated that the County could accept a <br />road as public without accepting maintenance obliga- <br />tions. <br />Collins reminded the Board that criteria is in place <br />for private roads and clarification is needed in order <br />for Staff to accurately inform the public. <br />Tom Fisler, developer of the subdivision, indicated <br />that the two adjoining lots do not have access to the <br />private road according to the Road Maintenance Agree- <br />ment. <br />Eddleman noted that the private road criteria should be <br />addressed in the documentation for the subdivision. <br />
