0 R- A N G E C O U N T Y 08i <br />BOARD OF COMMISSIONERS <br />ACTION AGENDA ITEM ABSTRACT <br />Meeting Date 7 <br />Action nda <br />Item <br />SUBJECT: POLICY - APPLICATION OF SECTION III -D -4 -a OF THE <br />SUBDIVISION REGULATIONS <br />ACTION BY: June 16, 1987 <br />DEPARTMENT: PLANNING PUBLIC HEARING Yes _X No <br />ATTACHMENT(S): <br />INFORMATION CONTACT: Marvin Collins <br />Section IiI -D -4 -a - Subdivision Regulations <br />Section V - Subdivision Regulations <br />TELEPHONE NUMBERS: <br />Hillsborough - 732 -8181 <br />Durham - 688 -7331 <br />Mebane - 227 -2031 <br />Chapel Hill - 968 -4501 <br />PURPOSE: Consideration of a policy for applying the provisions of <br />Section III -D -4 -a of the Subdivision Regulations to major <br />subdivisions. <br />BACKGROUND: Section III -D -4 -a of the Subdivision Regulations outlines <br />the procedures for preliminary subdivision plat approval. <br />Among the procedures is the following requirement: <br />"In cases where the completion and development of the <br />subdivision would require permits granted by an agency, that <br />agency shall officially approve by C_ertific.Ate or permit <br />the subdivision proposal." <br />Agencies which review preliminary plats for major <br />subdivisions include NCDOT, public water /sewer providers, <br />the N.C. Division of Environmental Management, the N.C. <br />Division of Health Services, local school boards, the Soil <br />and Water Conservation Service, and Planning and Health <br />Departments, including Erosion Control. <br />Since the adoption of the Subdivision Regulations countywide <br />In 1978, preliminary subdivision plats have been approved <br />without all certifications or permits as required by Section <br />III- D -4 -a. This procedure has been used for the following <br />reasons: <br />1. Some agencies do not respond to requests for comment <br />and /or approval or do not have adopted plans on which to <br />base comments and /or approvals. <br />
