Harvey, Planner III (919) 245 -2597 <br />Craig Benedict, Director (919) 245 -2592 <br />PURPOSE: To hold a quasi-judicial public hearing and receive sworn testimony and evidence on a <br />Class A Special Use Permit application in accordance with Section 2.7 Special Use Permits and <br />Section 5.9.3 of the Orange County Unified Development Ordinance (UDO) proposing the <br />development of a solar array public utility. <br />A quasi-judicial hearing means that testimony is sworn and evidence must be competent and <br />substantial. Hearsay or unsubstantiated opinions are not sufficient testimony. Board members are <br />also prohibited from engaging in conversations with anyone on the merits of project outside of the <br />public hearing process. Such conversations, commonly referred to as `ex -parte communications' are <br />prohibited. <br />BACKGROUND: On February 25, 2015 staff received an application proposing the development of <br />a 5 megawatt solar array public utility facility on a 20 acre portion of a 35.8 acre parcel of property <br />owned by William and Carol Byron off of White Cross Road. <br />The basic facts of the application are as follows: <br />Applicant: White Cross Solar LLC <br />176 Mine Lake Court, Suite 100 <br />Raleigh, NC 27615 <br />Property Owners: William and Carol Byron <br />1606 White Cross Road <br />Chapel Hill, NC 27516 <br />
