<br />STATE OF NORTH CAROLINA <br />COUNTY OF ORANGE <br />AMENDMENT TO LEASE <br />THIS AMENDMENT TO LEASE, made and entered into this the 1st day of May <br />2008, by and between Carr Miil Mall Limited Partnership, a North Carolina Domestic <br />Limited partnership, hereinafter referred to as "LANDLORD", and, Orange County, a <br />politic subdivision of the State of North Carolina, hereinafter referred to as "TENANT"; <br />WIT'NESSETH: <br />THAT, WHEREAS, the parties hereinto entered into a Lease Agreement dated <br />October 4, 1985 and renewed on March 3, 1991, November 2, 1993, May 14, 1996, May <br />6, 1998, and renewed and amended on May 1, 2003 (the "Lease"), containing SS80 <br />square feet of leasable area, in the Carr Mili Mali, and identified as space # D-1S. <br />WHEREAS, the parties hereto have mutually agreed as herein set forth; <br />NOW, THEREFORE, in consideration of the sum often dollars ($10.00) in hand, <br />paid by each of the parties hereto, and for other good and valuable consideration, the <br />receipt and adequacy of is hereby mutually acknowledge, the parties hereby agree as <br />follows. <br />1. The Lease term is hereby renewed for a period commencing on July 1, 2008 and <br />continuing through June 30, 2011. <br />2. Section 2 (a) of the Lease will be modified as follows: During the term of this <br />renewal period, Tenant shall pay to Landlord rent in the amount of $99,048.00 per <br />year, in monthly installments of $8,254.00. Payable in advance, on the first of <br />each month. <br />3. Sections 2 (b), (c), (d) and (e) are deleted. <br />4. Tenant accepts premises "as is". <br />
