23 <br />1 <br />Perdita Holtz saidcurrently the Joint Planning Agreement says the Rural Bufferisonly <br />2 <br />for limited uses, primarily residential. She said the use of Low Intensity Agricultural Enterprises <br />3 <br />in the RBis being added. <br />4 <br />Commissioner Jacobs said clustering in not currently in the Rural Buffer. <br />5 <br />Craig Benedict said yes. He said a five acre density can go down to a two acre lot. <br />6 <br />Commissioner Jacobs said adopting clustering would involve all three jurisdictions. <br />7 <br />Craig Benedict said yes. He said zoning lot sizes would have to be studied in the <br />8 <br />different sections of the Rural Buffer sincesome are inthe University Lake area and some are <br />9 <br />in the Jordan Lake area. <br />10 <br />Commissioner Jacobs said adopting the language would not affect the standard. <br />11 <br />Craig Benedict said that this provision was narrower,pertaining to agricultural uses. He <br />12 <br />said the BOCC asked for more liberal uses in the Rural Buffer,and the Towns had a counter <br />13 <br />proposal that said if that is to happen there should be some restrictions regarding agriculture. <br />14 <br />He said it was an offer of compromise. <br />15 <br />Commissioner Jacobs said he was the Planning Board Chair when theJointPlanning <br />16 <br />Agreementwas first created. He said originally all three jurisdictions were to approveevery <br />17 <br />development within the Rural Buffer. He said this proved unrealistic and a compromise was <br />18 <br />reached that placed trust on the County tofollow the land use planthat was adopted jointly. He <br />19 <br />said he finds this change in language not ideal but it fulfills a promise made to the property <br />20 <br />owners in the Rural Bufferto refine the Joint Planning Agreement to allow them to farm and <br />21 <br />stay on their land if so desired. He said a bit of restriction on the BOCC seems reasonable if <br />22 <br />the greater goal is achieved. He added he would like to have a discussion about clustering now <br />23 <br />that all elected officials are aware of the Rural Bufferand the Joint Planning Agreement that <br />24 <br />perhaps some of the refining can now be done and make it more viable long term to accomplish <br />25 <br />its goals. <br />26 <br />Commissioner Rich saidwill this be reviewed annually with other elected officials. <br />27 <br />Perdita Holtz said it is an annual review andwill probablybean item on the AOG. <br />28 <br />Commissioner Rich said if a change is requested prior to the AOG then a public hearing <br />29 <br />would be scheduled. <br />30 <br />Perdita Holtz saidyes. She said a public hearing would be required in order to make a <br />31 <br />text change to theUDO only if the change pertained to agricultural support uses in the RB. <br />32 <br />Commissioner Price said any desired change outside of agricultural support uses would <br />33 <br />wait until the annual joint public hearing for discussion. <br />34 <br />Perdita Holtz said there is opportunity for two joint public hearings. She said only one <br />35 <br />joint public hearing is formally listed but it is understood by all local governments that a public <br />36 <br />hearing can occur at the joint meeting with the Town of Chapel Hill in March or with the Town of <br />37 <br />Carrboro in October. <br />38 <br />39 <br />A motion was made by Commissioner Jacobs,seconded by Commissioner Pelissier to <br />40 <br />adopt the Resolution contained in Attachment 1 which approves the amendments to the Joint <br />41 <br />Planning Land Use Plan and Agreement. <br />42 <br />43 <br />VOTE: UNANIMOUS <br />44 <br />45 <br />8.Reports <br />46 <br />47 <br />NONE <br />48 <br />49 <br />9.County Manager’s Report <br />50 <br /> <br />
