14 <br />19 <br />or deliberate the boardÔs position concerning convention <br />resolutions, elections of association officers, and similar is- <br />sues that are not legally binding upon the board or its con- <br />stituents. <br />Comment: See G.S. 153A-40(c). That statute also speaks of <br />two other categories of gatherings that may be held outside <br />the boundaries of the county: retreats, and meetings with the <br />legislative delegation representing the county in the General <br />Assembly. The statute expressly forbids the board to take any <br />official action at any such meetings, so they are not mentioned <br />in the proposed rule. However, such meetings are covered by <br />the Open Meetings Law if a majority of the board is present <br />and ÑdeliberatesÒ on public business. <br />V. Agenda <br />(a) The county manager shall prepare the agenda <br />Rule 8. Agenda. <br />for each regular, special and emergency meeting subject to revie <br />and approval by the chair and vice-chair. A request to have an i <br />of business placed on the agenda must be received by 12:00 noon, <br />Monday of the week prior to the meeting. Any Board member may <br />petition the Board to have an item placed on the agenda. <br />(b) The agenda packet for regular meetings shall include the <br />agenda document, any proposed ordinances or amendments to <br />ordinances, and supporting documentation and background in- <br />formation relevant to items on the agenda. A copy of the agenda <br />packet shall be delivered to each member of the board at least <br />ninety-six hours before the meeting. Documents in the agenda <br />packet, if not previously available for public inspection, shall <br />come so when packets have been delivered to each board mem- <br />ber or left at his or her usual dwelling. Copies shall be avail <br />for members of the public in the clerkÔs office and at the Orang <br />County Main Public Library. Quarterly Public Hearing Agendas <br />shall also be placed at the Chapel Hill Library. The agenda is <br />also published on the countyÔs web site, orangecountync.gov. <br /> <br />
