The Efland Area resident group has suggested that if /when a Comprehensive Transportation Plan <br />the includes future right -of -way designation is adopted, this type of requirement can be added to the regulations at <br />that time. Until such time, the proposed language is premature. <br />20 The County Attorney's office has advised Planning staff to remove this statement. It was included primarily for <br />informational purposes to help people who are located within both the MTC overlay district and the Efland Village <br />overlay district know they did not have to research the requirements of the MTC overlay district since only one part <br />of the existing requirements (prohibition of off premise commercial signs) apply to the properties located in both <br />districts. <br />21 Some of the zoning districts that could be applied in a CITAN allow buildings taller than 40 feet. A building <br />height limitation of 40 -feet is suggested in order to maintain an urban village character. <br />22 The fencing regulations [(1) and (2)] are in keeping with the ECOD regulations in order to discourage unaesthetic <br />fencing in the front yards of properties. The Efland Area Resident Group has suggested that fences should be <br />allowed in the front yard of duplex and multi - family uses but should be limited to 5 -feet in height. <br />23 The Efland Area Resident Group has suggested that chain link fencing should be allowed as a fence type, so the <br />proposed standard is shown as proposed for deletion. The new language in (2) is to achieve the 5 -foot height <br />restriction mention in footnote 21.
