The only difference in this plan is that the open space will be shifted to the <br />end of the cul-de-sac. Staff is recommending approval. <br />Brian Crawford: Will the open space be in a homeowners association? <br />Eddie Kirk: All the open space will be in the homeowners association. There is one error on <br />page 58, G2 should read, "The open space shall be conveyed into the Homeowner's <br />Association". The last part of that sentence "before Planning Department signatures are affixed <br />to the final plat" should be deleted. _ . <br />Steve Yuhas: On item E3, we have a problem with open space that is dedicated to the <br />Homeowners' Association should be counted as recreation space for the purpose of Zoning. <br />The Planning Board decided then that open space should be counted toward the recreation <br />space requirement which is embodied in the zoning regulation. <br />Jeffrey Schmitt: What is the statute? <br />Craig Benedict: Back when these came forward, there was conventional or flexible. <br />Conventional had no open space required so in the absence of any dedication you had at least <br />.028% to provide as private recreation. <br />Steve Yuhas: We are not getting any credit for it being open space for the 35% of the property <br />dedicated as open space. <br />37 <br />
