Approved 9/5/07 <br />Acreage required to be reserved for private recreational facilities is 1.7 acres (60.09 x .028). The difference <br />between the public trail system proposed and the private recreation is approximately 1.1 acres. More <br />accurate calculations will be provided with the preliminary plan <br />Applicant will show private recreation facilities and areas the on Preliminary Plat, when submitted. Private <br />recreation areas may be shown within designated open space areas for certain activities. <br />All lots but one have direct access to open space. Lot 13 is within 80 feet of a direct access point. <br />Agency Review: . <br />® Comments Attached. <br />® Phone conversation with NCDOT indicated acceptance of the Concept Plan. Amore through review will be <br />done at the Preliminary Plan stage. <br />Development Process, Schedule, and Action <br />® First Action: Neighborhood Information Meeting: Held July 17, 2007 <br />Issues Discussed: (see attached NIM Comments) <br />a Neighbors questioned various aspects of the development including: lot sizes, sale prices, effect on <br />taxes, road stub, water and sewage disposal, and reputation of the developer. <br />Planning Board: <br />' Second Action: Planning Board to consider Concept Plan <br />Options:1. Action within two regularly scheduled Planning Board meetings, or extension <br />thereof; <br />2. If the Planning Board fails to act within the specified time period, application forwarded to <br />BOCC with Planning Board minutes and Planning Staff recommendations and conditions. <br />3. If approved the applicant shall have two (2) years to prepare and file a <br />Preliminary Piat application. If a Preliminary Plat has not been submitted <br />within the specified time limit, the Concept Plan shall become null and void <br />RECOMMENDATION(S): Staff Recommendation <br />The Planning Staff recommends Approval of the Concept Plan for Swallow's <br />Ridge with the following conditions: <br />1. The intersection and road alignments on the Preliminary Plan shall meet <br />NCDOT standards. <br />2. A dedication of an additional 5 feet of Right of Way, or 35 feet from the <br />centerline of the Right of Way, whichever..is greater, will be required along <br />University Station Road. <br />3. Homeowners Association documents that provide for maintenance of the <br />Open Space shall be submitted with the preliminary plan. Provisions shall be <br />included in the Homeowners Association documents that would prohibit tree <br />cutting in the Open Space except for maintenance purposes. <br />4. .Show location of subdivision sign on Preliminary Plan, and reserve an <br />easement for the sign. <br />5. Show the Type A land use buffer along University Station Road. <br />6. Show the location of all public and private recreation areas. <br />7. Any lighting shall meet Orange County Lighting Standards. <br />8..
