r <br /> 2 <br /> Public Hearing Comments <br /> Citizen comments both for and against the proposed <br /> amendment were received at the Public Hearing on February <br /> 28, 1994. <br /> The Orange Water and Sewer Authority was opposed to the <br /> relaxation of any watershed protection standard, <br /> particularly when applied to the Cane Creek Watershed. <br /> Several citizens spoke in favor of the amendment because a <br /> number of existing lots, particularly those surrounding <br /> Lake Orange, are rendered unbuildable by the setback <br /> requirements. <br /> The Staff response to key questions and issues raised at <br /> the public hearing is attached. The Planning Staff <br /> recommends approval of the amendment on the basis that it <br /> allows for a more expedient and efficient process for <br /> addressing as many as 70 situations which would now <br /> require action by the Board of Adjustment. <br /> Planning Board Recommendation <br /> The Planning Board considered the proposed amendment on <br /> April 18, 1994, and, after considerable discussion, <br /> recommended approval by a vote of seven to two. Minutes <br /> of the Planning Board meeting are attached. <br /> Board of Commissioners Action - May 2, 1994 <br /> The proposed amendment was included as an Item for <br /> Decision on the May 2, 1994 Commissioners Agenda. Due to <br /> the late hour, the discussion was limited to OWASA <br /> comments and follow-up questions to Planning Staff. No <br /> decision on the amendment was made. <br /> The County Manager contacted Planning Staff on May 10, <br /> 1994, for clarification of and information related to the <br /> key points raised during the public hearing process. The <br /> following information was provided: <br /> - The amendment affects existing lots only; <br /> - The alternative to approval of the amendment is for <br /> affected property owners to seek relief from the Board <br /> of Adjustment; <br /> - It is highly unlikely that there will be any affected <br /> properties in the Cane Creek or University Lake <br /> Watershed; <br /> It is possible that there could be 50 to 70 variance <br /> requests for properties surrounding Lake Orange if the <br /> amendment is not approved; <br />
