Progress Report #3 - 4/8/08 -with <br />Preliminary Commercial Terms and <br />Legal Terms, Proposed Project <br />Schedule, and Proposed Project Map <br />INFORMATION CONTACT: <br />Gwen Harvey, Assistant County <br />Manager, 245-2307 <br />Gayle Wilson, Solid Waste, 968-2885 <br />Bob Sallach, Olver, Inc. <br />Ray Dubose, UNC Energy Services <br />PURPOSE: To present an update from the County and UNC teams -the third and final report <br />as specified under the Memorandum of Understanding (MQU) dated January 17, 2008 - on the <br />development feasibility of a landfill gas to energy project on Eubanks Road to benefit Carolina <br />North, and to request BOCC authorization to proceed towards final contract negotiations. <br />BACI~CGROUND: On January 15, 2008, the BOCC authorized entering into an (MOU) with the <br />University of North Carolina at Chapel Hill to ensure due diligence and anticipate effective <br />implementation of a landfill gas recovery project. The MOU was designed to focus time and <br />attention on the following outcomes: <br />Energy Generation/Ultimate Use <br />Short term gas flaring and energy generation, preferably to benefit the Carolina North <br />development <br />Economic Feasibility <br />A business and financial scenario favorable to both the County and the University, ideally one <br />that would negate the need for the University to subcontract with a third party for the generation <br />and/or use of the landfill gas <br />Due Diligence <br />An obligation. by both parties to work aggressively within a 90 day window to bring forth a <br />credible, joint plan of action -including Preliminary Commercial and Legal Terms -for the <br />beneficial reuse of the gas by the University, pending final negotiations and review by the <br />County Manager and County Attorney. Ultimate approval of a final contract rests with the <br />BOCC. <br />
