054 <br /> 2 <br /> a small portion of the site, OWASA requests that the <br /> entire 68.4-acre lot be rezoned in order to accommodate <br /> its possible future use for biosolids composting <br /> facilities. <br /> In November 1993, the Planning Department received an <br /> Environmental Assessment Application from OWASA to <br /> accommodate the construction of a wastewater biosolids <br /> (sludge) storage facility. This would consist of two <br /> Aquastore Factory Coated Glass-Fused-to-Steel Bolted <br /> Tanks, manufactured by A.O. Smith Harvestore Products on <br /> the OWASA property in Bingham Township. The Planning <br /> Staff broadly circulated the Application through the North <br /> Carolina State Clearinghouse for comments from numerous <br /> agencies at the Federal, State, Regional, and Local levels <br /> in November and December 1993. No adverse comments were <br /> received. After more site information was provided by <br /> OWASA, the Planning Department declared a "Finding Of No <br /> Significant Impact" (FONSI) on February 25, 1994, in <br /> accordance with Sections 2 and 3 of the Orange County <br /> Environmental Impact Ordinance. <br /> RECOIrIIMMATION: Article 20.3.3 of the Zoning Ordinance requires the Zoning <br /> Officer's recommendation to be presented to the Planning <br /> Board within 30 days of receipt of an application. The <br /> 30-day period may be extended up to 60 days with the <br /> written consent of the applicant. The public hearing is <br /> the time for the Zoning Officer's recommendations. <br /> Zoning Officer's Recommendations <br /> The Zoning Officer has reviewed the application and all <br /> supporting documentation, and has found that the proposed <br /> rezoning would be consistent with the Comprehensive Plan. <br /> Provided the Planning Board and the Board of County <br /> Commissioners find in the affirmative, the Zoning Officer <br /> recommends approval of the request. <br /> No decision is made by either the Planning Board or County <br /> Commissioners at the public hearing. Instead the Planning <br /> Board has 60 days within which to prepare and submit a <br /> recommendation to the Board of Commissioners. Failure of <br /> the Planning Board to submit a recommendation within the <br /> required time shall be considered a favorable <br /> recommendation, without conditions. <br /> The Administration's Recommendation <br /> The Administration recommends that the proposed Zoning <br /> Atlas amendment be referred to the Planning Board for a <br /> recommendation to be returned no sooner than August 8, <br /> 1994 . <br />
