24 <br /> hereafter constructed only upon the repair, replacement, <br /> construction and approval of each by the North Carolina Division of <br /> Environmental Management, the Orange County Health Department and <br /> OWASA. The COUNTY shall own the Subdivision wastewater system and <br /> the STEP systems until: <br /> (i) OWASA's sewer system is extended to the Subdivision; or <br /> (ii) the COUNTY's Clean Water grant application is denied; or <br /> (iii) a minimum of one ( 1) year has elapsed following the <br /> closeout of the Clean Water grant project and the final approval of <br /> the grant project by the State. Within a reasonable amount of time <br /> following the happening of the first of the events described in <br /> ( i) , (ii) and (iii) above, the COUNTY agrees to convey to OWASA and <br /> OWASA agrees to accept from the COUNTY all of the COUNTY's right, <br /> title and interest to the Subdivision wastewater system, including <br /> the STEP systems . <br /> 4 . The parties agree that the Subdivision wastewater system <br /> can only be properly repaired if repairs are made to some or all of <br /> the STEP systems in the Subdivision and that those repairs are a <br /> part of the project and the cost of those repairs is part of the <br /> project expense. Each existing STEP system shall be inspected by <br /> OWASA, the Orange County Health Department and the Subdivision <br /> wastewater system engineer (hereafter defined) . Repairs to each, <br /> if any, shall be specified by the Subdivision wastewater system <br /> engineer, approved by OWASA and the Orange County Health Department <br /> and completed as part of the Subdivision wastewater system project. <br /> 5 <br />
