34 <br /> r <br /> A RESOLUTION WITHDRAWING THE TOWN OF HILLSBOROUGH <br /> FROM THE COOPERATIVE PLANNING AGREEMENT <br /> WHEREAS, the Town of Hillsborough and Orange County entered into a <br /> cooperative planning agreement on or about October 14, 1991, the purpose of which <br /> was to establish a method of cooperative and comprehensive planning within the <br /> "cooperative planning area" as defined in that agreement; <br /> WHEREAS, section 1.3 of that agreement provides that it may be terminated <br /> by the withdrawal of either party upon thirty days written notice to the other <br /> party; and <br /> WHEREAS, the town is contemplating the annexation of a tract of <br /> approximately 865 acres, known as the University Station property, together with <br /> various intervening properties; and <br /> WHEREAS, the above described land is designated as part of an "open space <br /> area" under the cooperative planning agreement; and <br /> WHEREAS, the cooperative planning agreement provides that the town may not <br /> annex land located within the open space area while that agreement remains in <br /> effect; <br /> NOW THEREFORE, THE BOARD OF COMMISSIONERS OF THE TOWN OF HILLSBOROUGH <br /> RESOLVES: <br /> Section 1. Pursuant to article 1 section 1.3 of the cooperative planning <br /> agreement between the town and Orange County, the town hereby notifies Orange <br /> County that the town is withdrawing from the cooperative planning area agreement, <br /> effective June 29, 1994.. <br /> Section 2. A copy of this resolution shall be delivered forthwith to the <br /> Orange County Manager for distribution to the Orange County Board of <br /> Commissioners. <br /> Section 3. All provisions of any town ordinance or resolution in conflict <br /> with this resolution are repealed. <br />
