Amendments to the JPA <br /> Land use Plan require the unanimous approval of <br /> Chapel hill, Carrboro, and Orange County as <br /> specified in the Joint Planning Agreement. <br /> CP-1-94 requests the establishment of a rural <br /> industrial activity node covering the subject <br /> properties. A rural industrial activity node is <br /> land focused on designated road intersections in <br /> the rural areas that is appropriate for small <br /> scale industrial uses which do not require urban- <br /> type services. Such an amendment requires only <br /> the approval of the Orange County Commissioners. <br /> Almost identical amendments, JPA-1-91 and CP-3-91, <br /> were considered at a Joint Public Hearing on <br /> October 10, 1991. Concern with potential <br /> environmental impacts was raised during the public <br /> hearing process. Two particular areas of concern _ <br /> dealt with the proposed relocation of an existing <br /> asphalt plant (currently located on lot 9E, <br /> Bingham Township Tax Map 28) and the effects of <br /> blasting on surrounding properties. <br /> Though not a requirement of the plan amendment <br /> process, the applicants chose to prepare and <br /> submit an Environmental Impact Statement (EIS) as <br /> specified in the Orange County Environmental <br /> Impact Ordinance. The EIS was presented at a JPA <br /> Public Hearing held on October 14, 1993. Since <br /> that hearing, the applicants have decided to <br /> withdraw the proposal for relocating the asphalt <br /> plant. A letter to that effect from David M. <br /> Rooks, III, dated March 17, 1994 is included with <br /> the application materials. Minutes of the October <br /> 14, 1993 and October 10, 1991 public hearings are <br /> also included as attachments separate from the <br /> application materials and staff evaluation. <br /> Finally, a letter from Paxton Badham dated March <br /> 24, 2994 which responds to residents' concerns <br /> expressed in the minutes is attached. <br /> RECOMMENDATION= The Orange County, Chapel Hill, and Carrboro <br /> Planning staffs recommend approval of the proposed <br /> amendments as contained in the attached analysis. <br /> Following conclusion of the public hearing, the <br /> matter should be referred to the towns of Chapel <br /> Hill and Carrboro for decision and then to the <br /> Orange County Planning Board for a recommendation <br /> to the Orange .County Commissioners.
