Teer <br /> Company will terminate use of the existing asphalt plant located <br /> adjacent to the former quarry (reservoir) in May 2000. <br /> To obtain the required zoning and special use permit for quarry <br /> expansion, the applicants were advised that they would first have <br /> to pursue amendments to the Joint Planning Area Land Use Plan and <br /> Land Use Element of the Orange County Comprehensive Plan. <br /> Applications JPA-1-91 (expansion of the extractive use category) <br /> and CP-3-91 (creation of a rural industrial activity node) were <br /> submitted by the applicants and presented at public hearing on <br /> October 10, 1991. Concern with potential environmental impacts was <br /> raised during the public hearing process. Two particular areas of <br /> concern dealt with the proposed relocation of the existing asphalt <br /> plant (currently located on lot 9E, Bingham Township Tax Map 28) <br /> and the effects of blasting on surrounding properties. <br /> Though not a requirement of the plan amendment process, the <br /> applicants chose to prepare and submit an Environmental Impact <br /> Statement (EIS) as specified in the Orange County Environmental <br /> Impact Ordinance. The EIS was presented at a JPA public hearing on <br /> October 14, 1993. Since that hearing, the applicants have decided <br /> to withdraw the proposal for relocating the asphalt plant and have <br /> provided documentation of their efforts to address impacts on <br /> surrounding properties. Findings of the EIS will be cited, as <br /> appropriate, in the evaluation of the application. <br /> APPLICATION REQUIREMENTS <br /> Application requirements for an amendment to the Orange County <br /> Comprehensive Plan are contained in Articles 2 and 20 of the Orange <br /> County Zoning Ordinance. Although this proposed amendment is to <br /> the Joint Planning Area Land Use Plan, it falls within the Rural <br /> Buffer area in which provisions of the Orange County Zoning <br /> Ordinance are in effect. Listed below are the application <br /> requirements, with analysis of information supplied by the <br /> applicant (shown in bold) . <br /> 1. Article 2.2.14 states the reasons for which the <br /> Comprehensive Plan may be amended. <br /> a. Because of changed or changing conditions in a <br /> particular area or areas of the County; <br /> The applicant states that the continued growth in <br /> southern Orange County has placed a premium on the <br /> location and development of sources of drinking <br /> pater and this is the principal changing condition <br /> which makes the proposed amendment reasonably <br /> necessary. The applicant describes changing <br /> conditions as follows: <br /> 4 <br />
