htj <br /> .gym 3 <br /> RESOLUTION BY BOARD OF COMMISSIONERS OF THE COUNTY OF ORANGE <br /> WHEREAS: The North Carolina Clean Water Revolving Loan and Grant <br /> Act of 1987 has authorized the making of grants to aid <br /> eligible units of government in financing the cost of <br /> construction of wastewater systems, and <br /> WHEREAS: The County of Orange recognizes the need to replace the <br /> failing on-site ground absorption waste treatment <br /> system currently serving the Piney Mountain subdivision <br /> and intends to see constructed a wastewater <br /> transmission system, consisting of a sewer pumping <br /> station and approximately one mile of sewer force main, <br /> which will connect the existing waste water collection <br /> system serving the Piney Mountain subdivision to the <br /> waste water collection system of the City of Durham, <br /> and <br /> WHEREAS: The County of Orange intends to request state grant <br /> assistance for the project, <br /> NOW THEREFORE BE IT RESOLVED, BY THE BOARD OF COMMISSIONERS OF <br /> THE COUNTY OF ORANGE: <br /> That the County of Orange, if it receives and accepts the grant <br /> requested, will exercise if necessary its eminent domain power to <br /> acquire clear title to all interests in land essential to the <br /> project. <br /> That the County of Orange, if it receives and accepts the grant <br /> requested, will arrange financing for all remaining costs of the <br /> project. <br /> That County of Orange, if it receives and accepts the grant <br /> requested, will adopt and place into effect on or before <br /> completion of the project a schedule of fees and charges which <br /> will provide adequate funds for proper operation, maintenance, <br /> and administration of the system <br /> That the County of Orange, if it receives and accepts the grant <br /> requested, will provide for efficient operation and maintenance <br /> of the project on completion of construction thereof. <br /> That John M. Link, Jr. , County Manager, and successors so titled, <br /> is hereby authorized to execute and file an application on behalf <br /> of the County of Orange with the State of North Carolina for a <br /> grant to aid in the construction of the project described above. <br />
