2 <br />In reviewing these changes, staff has determined that the current review and approval process <br />governing telecommunication wireless facilities needs revision in order to be complaint with <br />current State law. Staff proposes to amend the existing sections of the Ordinance as proposed <br />on Attachment 1 in order to address this discrepancy. <br />The proposed amendments address the six (6) items listed above and, on the advice of our <br />telecommunications consultant, address the following additional issues: <br />1. Comprehensive informational requirements, <br />2. Comprehensive standards for evaluation, <br />3. Listing of facilities not requiring a Special Use Permit, <br />4. The intent of the annual meeting, <br />5. Detailed information for review, <br />6. Improve balloon test requirements, and <br />7. Detailed requirements of approval <br />It should be noted that apre-application meeting for two (2) new towers, which will require Class <br />"B" Special Use Permits from the Board of Adjustment, was conducted on January 4, 2008. <br />The required balloon tests are scheduled from the, second and third week of February. A formal <br />submittal for both telecommunication facilities is expected sometime in early March. <br />This proposed amendment is extremely critical to ensure that we are adhering to proper <br />procedure when reviewing/taking action on these applications. <br />FINANCIAL IMPACT: There is no direct economic impact. Staff time has been accounted for in <br />the departmental budget. <br />Any new application under these Zoning Ordinance amendments will require a fee, which will <br />re-imburse the County for staff time required to receive, process, and present the application to <br />the appropriate board or boards. <br />RECOMMENDATION: The Manager recommends that the Board: <br />1. Receive the proposed amendments, <br />2. Conduct the Public Hearing to solicit and consider public input on the proposal, <br />3. Forward the matter to the Planning Board for review and comment with a request that a <br />recommendation be submitted back to the BOCC no later than May 20, 2008. <br />
