QP9 <br />Excerpt: SUMMARY MINUTES OF A REGULAR BUSINESS MEETING <br />OF THE CHAPEL HILL TOWN COUNCIL <br />WEDNESDAY, JULY 7, 1099 AT 7:00 P.M. <br />Item 17 —Petitions <br />a. By the Mayor and Council Members <br />Mayor Waldorf reminded the Council that it had made a commitment to make zoning changes on <br />the 60 acres of the Greene Tract that were designated for solid waste use. She suggested- that a8 a <br />show of good faith the Council might set a date, such as October 18'h, for a hearing.. <br />Council Member Brown asked if this would be a public hearing to change the zoning. Mr. <br />Horton explained that it would be'to change what was permitted within existing zoning. Mayor <br />Waldorf said that it meant adding material recovery facilities (vIRF) and transfer stations as <br />permitted uses rather than special uses, which was what they would be in that area. <br />Council Member Foy asked if it would be more than that'60 acres. Mr. Horton said that it would <br />actually apply to wherever that zoning district was. <br />Council Member Brown said that the Council was not sue what they were calling the hearing <br />for. Mayor Waldorf stated that her intent was to propose that the Council make amendments to <br />the De#elopment Ordinance and the Zoning Atlas, if necessary, "to enable MRFs and transfet <br />stations to be permitted uses on the 60 acres of ' the Greene Tract that had been identified as <br />exhibit E and had been identified as the acres that will be reserved for solid waste purposes." <br />Council Member Brown said that she was concerned about notification of the neighbors who, if <br />it was not a rezoning, would have recourse to a protest petition. Mr. Horton said that it would not <br />be a rezoning and that the Town would advertise it in the same fashion that it would advertise <br />any ordinance text amendment. <br />Mayor.pro tern Capowski asked if there were any other rural transition areas other than the <br />Greene Tract. Mr. Waldon. replied, that there were, and listed them. <br />1%&. Horton recommended that the Council call. the public hearing for the purpose of considering <br />a new zone that would be limited to that sixty aces. <br />Coun6il Member Brown asked if it would be similar to what they did with Scarlette Drive which <br />could involve a protest petition. Mr. Horton replied that it would be. Mayor Waldorf said that <br />this was a much better solution. <br />COUNCIL MEMBER FOY MOVED, SECONDED BY COUNCIL MEN113ER PAVAO, TO <br />HOLD A PUBLIC HEARING ON OCTOBER 18, 1999, TO CONSIDER AN AMENDMENT <br />TO THE DEVELOPMENT ORDINANCE TO REZONE THE 60 ACRES. OF THE GREENE <br />TRACT TO PERMIT THE USE OF A TRANSFER FACILITY OR A MATERIALS <br />RECOVERY FACILITY THERE.' THE MOTION WAS ADOPTED UNANIMOUSLY (9-0). <br />
