Orange County Board of Commissioners <br />Page 3 <br />March 14, 2008 <br />In summary, I think changing the use of the 60 acre portion <br />of the Greene Tract from' "reserved for System purposes" to some <br />other use must be accomplished by further amendment to the <br />Agreement. The logic and the clear intent of the Agreement is <br />that such a further amendment would, in effect, call for <br />treating all of the Greene Tract the same, triggering the <br />"Reimbursement amount" provision of the Agreement in the same <br />manner as with the 104 acre parcel. If the use of the 60 acres <br />becomes the public purpose of "conservation," Carrboro,-Chapel <br />Hill and the County would contribute to the reimbursement in <br />proportion to their pre Agreement ownership interest in the <br />entire Greene Tract, Carrboro 140, Chapel Hill 43% and Orange <br />County 430. <br />GEG /lsg <br />Enclosures <br />xc: Laura E.
