2 <br /> • present and future ownership in real property <br /> • mothods of amending or terminating organizational charter <br /> • administration of the organization <br /> • t:.ming the creation of the new organization <br /> The following sections on each of the above issues note the areas <br /> previously discussed by the Reorganization Group and raises <br /> additional questions that could be discussed. <br /> Purpose <br /> As agreed upon at the November 3 meeting, the newly constituted <br /> Landfill OxAners Group would be responsible for solid waste <br /> prevention, processing and disposal activities. Responsibility for <br /> solid waste: collections would remain with the individual <br /> governments. Responsibility for recycling collections needs to be <br /> clarified and may be dependent upon what collection or processing <br /> methodology is chosen. For example if co-collection vehicles are <br /> utilized it would be possible for each local government to be <br /> responsible for both solid waste and recyclables collection. If <br /> the current system of source separated recyclable collection is <br /> maintained, it may be advantageous for recycling collections to <br /> continue to be contracted out and provided by the Owners Group. <br /> Some governnents may not be interested in assuming recycling <br /> collection responsibility. <br /> Powers of the Board <br /> The Reorganization Working Group has expressed the desire to give <br /> the new organizational structure more powers than the present <br /> Owners Grour to make certain that it is a decision-making rather <br /> than an advisory body. All powers delegated to the new structure <br /> must be specified in the agreement that forms the new organization. <br /> Powers granted to the new entity could include one or- all of the <br /> following abilities: <br /> • Require participation in recycling programs; <br /> • Set and charge fees and penalties for the use and <br /> availability of disposal/processing facilities; <br /> • Lease property; <br /> • Enter into installment contracts; <br /> • Own land and negotiate land purchases and sales; <br /> • Adopt a budget and approve budget changes; <br /> • Ap-prove major construction and bid awards; <br /> • App?rove significant changes to construction projects; <br /> • Es•:ablish, expand and eliminate solid waste management <br /> programs; <br /> ; = <br /> ` _, The above list is merely suggestive and not an exhaustive list of <br /> potential pokers. <br />
