Davis <br /> Analysis of Proposed Comprehensive Plan Amendment <br /> On October 5, 1995, a petition for amendment to the Land Use Element of the Comprehensive <br /> Plan was submitted by Charles W. Davis and James L. Davis. In accordance with Articles 2 and <br /> 20 of the Zoning Ordinance, the proposed amendment is evaluated on the following pages. <br /> A. GENERAL DESC <br /> The property proposed for amendment lies in Hillsborough Township, on the south side of Cates <br /> Creek between NC 86 and Old Chapel Hill-Hillsborough Road (Old NC 86). The site is <br /> undeveloped. <br /> The property in question is a 50-acre portion of a 108-acre parcel and is referenced as part of <br /> parcel 2, tax map 45, Hillsborough Township. The site is adjacent to the Town of Hillsborough <br /> Extra-Territorial Jurisdiction on the north and west, a County Transition Area and Stagecoach <br /> Run subdivision to the east, and the I-40/Old 86 Economic Development District to the south. <br /> The 108-acre parcel which contains this amendment site is currently in split planning jurisdiction <br /> (please see attached map). Approximately 5.5 acres of the parcel (between Cates Creek and Old <br /> Chapel Hill-Hillsborough Road) is in the Town of Hillsborough Extra-Territorial Jurisdiction. <br /> Approximately 102.5 acres of the parcel is in County jurisdiction. The 50-acre portion proposed <br /> for amendment is currently designated Rural Residential, while the 52.5-acre remainder to the <br /> northeast is designated Twenty-Year Transition. <br /> The proposed amendment would redesignate the 50-acre Rural Residential portion of the <br /> property to Twenty-Year Transition, which would place the entire parcel in the Twenty-Year <br /> Transition designation. Twenty-Year Transition is described in the Land Use Element as "land <br /> located in areas that are in the process of changing from rural to urban, that are suitable for <br /> urban-type densities and should be provided with public utilities and services within the second <br /> 10-year phase of the Plan.* <br /> The proposed designation of Twenty-Year Transition would allow the potential for rezoning <br /> of the property to higher-density residential zoning in the future. The current zoning is R-1, <br />
