16 <br /> by the County the amount shall be a lien upon the land or premises <br /> where the discharge occurred, and shall be collected as unpaid <br /> taxes . <br /> ARTICLE VI ENFORCEMENT PROCEDURES <br /> Sec . 6 . 1 Criminal Penalties <br /> Any person who violates the provisions of this Ordinance or <br /> fails to comply with any of its requirements shall, upon <br /> conviction, be guilty of a misdemeanor and shall be punished as <br /> provided in N. C. Gen. Stat . §14-4 . <br /> Sec . 6 . 2 Civil Penalties <br /> (a) Any person who intentionally or negligently discharges <br /> oil or other hazardous substances, or knowingly causes or permits <br /> the discharge of oil in violation of this Ordinance or fails to <br /> report a discharge as required by Section 4 . 3 or who fails to <br /> comply with the requirements of Section 4 . 2 (a) or orders issued by <br /> the Department of Emergency Management as a result of violations <br /> thereof, shall incur, in addition to any other penalty provided by <br /> law, a penalty in the amount of one thousand dollars ($1, 000 . 00) <br /> for every such violation. Every act or omission which causes, aids <br /> or abets a violation of this subsection shall be considered a <br /> violation under the provisions of this subsection subject to the <br /> penalty herein provided. The penalty herein provided shall become <br /> due and payable when the person incurring the penalty receives a <br /> notice in writing from the County Manager describing the violation <br /> with reasonable particularity and advising such person that the <br /> 14 <br />
