25 <br /> This building has since been removed, and <br /> the area where the ball diamond and <br /> concession stand once stood, as late as <br /> 1982; now has a three-bay garage on it <br /> (built in 1990) and is now being used to <br /> store junked motor vehicles . <br /> 4 . If the property had been used for storage <br /> of junked motor vehicles on the effective <br /> date of the zoning ordinance, any <br /> building of structures for commercial use <br /> would be illegal as established in the <br /> provisions of Section 11.44 Intent <br /> Concerning Non-conforming Uses: <br /> Specifically Declared To Be Incompatible <br /> With Permitted Uses, which states: <br /> "It is the intent of this ordinance that <br /> non-conforming uses shall be considered <br /> to be incompatible with the Permitted <br /> Uses within the districts. Such non- <br /> conforming uses shall not be enlarged or <br /> extended in any respect. " <br /> A commercial operation was begun since <br /> adoption of zoning for the area, and it <br /> has expanded substantially over the past <br /> three-year period. <br /> S. On March 22, 1990, Mr. Combs received a <br /> building permit to construct a "Building, <br /> 45 ' x 321 , 1-story building. Will be used <br /> to store owner's own -cars. " The building <br /> permit application was signed by Mr. <br /> Combs. A garage for the storage of one's <br /> person vehicles is a permitted use in the <br /> RB Rural Buffer zoning district. After <br /> the customary inspections, a Certificate <br /> of Occupancy was issued on May 15, 1990. <br /> 6. On October 25, 1991, a complaint was <br /> received from a neighbor that Mr. Combs <br /> was operating an automotive repair and <br /> junked vehicle salvage business on the <br /> premises. <br /> 7 . On October 31, 1991, the Combs were cited <br /> for the use violation after it was found <br /> that the three-bay garage, with a lift, <br /> r-; electronic testing equipment, and other <br /> heavy motor vehicle maintenance and <br /> repair equipment, is being used for the. <br /> commercial purposes of parts recovery and <br /> repairing.
