It has been found that there was no <br /> zoning error made with respect to this <br /> property when zoning was adopted for <br /> Bingham Township on September 2, 1981. <br /> 1979 and 1982 aerial photographs show no <br /> commercial auto repair establishment or <br /> any storage of junked motor vehicles on <br /> the property. The photographs show a <br /> basebal•1 or softball diamond and <br /> concession stand on the premises. Four <br /> commercial establishments in Bingham <br /> Township were identified and zoned EC-5 <br /> when the ordinance was adopted. Other <br /> commercial properties were not zoned and <br /> their uses were designated' as non- <br /> conforming. <br /> 2 . The Combs purchases lot 6A on August 29, <br /> 1983 and lot 6 on January 22, 1991. <br /> Current commercial and outside storage <br /> land uses on these properties are in <br /> violation of Section 4.3 Permitted Uses <br /> of the Zoning Ordinance. <br /> 3. If the property had been used for the <br /> storage of junked motor vehicles on the <br /> effective date of the Zoning Ordinance, <br /> the use of the property today would be in <br /> violation of Section 11.8 Non-Conforming <br /> Uses of Land Without Structures or With <br /> Minor Structures of the Zoning Ordinance <br /> which states: <br /> "Non-conforming uses of land not <br /> involving any permanent structure with a <br /> replacement cost of $2,000 or combination <br /> of permanent structures with a <br /> replacement cost exceeding $5,000 as <br /> determined by the Zoning Officer shall <br /> cease within two years of the adoption of <br /> this ordinance, or any amendment which <br /> shall cause such uses to assume non- <br /> conforming status. " <br /> There was only one structure on the <br /> property when the ordinance was adopted - <br /> a concession stand used in association <br /> with the then existing ball diamond. <br />
