V--AJ <br /> 23 <br /> _ affected by the atlas change proposal is <br /> _-_ currently zoned RB Rural Buffer. The request <br /> has been made to correct an apparent error in <br /> the Zoning Atlas. <br /> The requested rezoning was initiated as a <br /> means of resolving a zoning violation <br /> involving the illegal operation of motor <br /> vehicle salvage and repair business and the <br /> storage of junked motor vehicles. The <br /> applicant alleges the rezoning will correct <br /> an error in the Zoning Ordinance, in that the <br /> property was used for the storage of junked <br /> motor vehicles prior to the zoning of Bingham <br /> Township in 1981. Planning Staff has been <br /> unable to substantiate the applicant's claims <br /> through the examination of aerial photos. A <br /> complete enforcement history titled <br /> Chronology of Events is an attachment to <br /> these minutes on pages (P(o_b o . <br /> Surrounding properties are subdivided for <br /> residential development and 'zoned RB/ULW <br /> Rural Buffer-University Lake Watershed to the <br /> east toward Ferguson Road and AR Agricultural <br /> Residential to the west. Current predominant <br /> existing land uses include forest and <br /> residential to the north, east and south, and <br /> forest to the west. <br /> An estimated forty citizens interested in <br /> this matter attended the public hearing and <br /> twelve testified in favor. Two questioned <br /> the rezoning. There was not strong argument <br /> against the requested rezoning. <br /> The testimony for the rezoning can be <br /> categorized into three areas which: <br /> 1. Expressed the value of and need for the <br /> service Combs provides to the State <br /> Highway Patrol and the County in general; <br /> 2. Provided statements that automobiles were <br /> being stored on the property on the <br /> ?r effective date of the Zoning Ordinance; <br /> and <br /> 3. Attested to the character of Mr. Combs. <br /> The testimony against the rezoning can be <br /> categorized into two areas: <br /> 1. Mr. Combs did not live on or own the <br /> property until 1983. <br /> 2. Mr. Combs has expanded his business <br />
