r <br /> Existing <br /> cause fraud on or victimization of the public, or conflict with other laws <br /> or ordinances. <br /> (3) Any applicant to whom a variance is granted shall be given written notice <br /> specifying the difference between the base flood elevation and the <br /> elevation to which the structure is built and stating that the cost of flood <br /> insurance will be commensurate with the increased risk resulting from the <br /> reduced lowest floor elevation. <br /> ARTICLE 6. ABROGATION AND GREATER RESTRICTIONS <br /> This ordinance is not intended to repeal, abrogate, or impair any greater restrictions imposed <br /> by existing easements, covenants, or deed restrictions. Wherever the provisions of any other <br /> law, ordinance or regulation impose higher standards than are required by the provisions of this <br /> ordinance, the provisions of such law, ordinance or regulation shall govern. <br /> ARTICLE 7. COMPLIANCE <br /> No structure or land shall hereafter be located, extended, converted, or structurally altered <br /> without full compliance with the terms of this ordinance and other applicable regulations. <br /> ARTICLE 8. VIOLATIONS AND PENALTIES <br /> (a) Any violation of this ordinance shall constitute a misdemeanor. <br /> (b) Failure to remove any artificial obstruction or enlargement or replacement thereof <br /> that violates this ordinance shall constitute a separate violation of this ordinance <br /> for each 10 days that such failure continues after written notice from the Zoning <br /> Officer of the violation. <br /> (c) In addition to any other remedy available to Orange County by law, Orange <br /> County is hereby empowered to institute any appropriate action or proceeding to <br /> restrain or prevent any violation of this ordinance, or to require any person, firm <br /> or corporation which has committed any violation of this ordinance to remove a <br /> violating obstruction or restore the conditions existing before the placement of the <br /> obstruction. <br /> ARTICLE 9. LIABILITY FOR DAMAGES <br /> Pursuant to N.C. Gen. Stat. Section 143-215.60, no action for damages sustained because of <br /> injury caused by obstruction for which a permit has been granted under this ordinance shall be <br /> brought against the State of North Carolina or Orange County or their employees or agents. <br />
