33 <br /> (3) All subdivision proposals shall have adequate drainage provided to reduce exposure to flood hazards; <br /> and, <br /> (4) Base flood elevation data shall be provided for subdivision proposals and other proposed <br /> development which is greater than the lesser of fifty lots or five acres. <br /> SECTION E. STANDARDS FOR AREAS OF SHALLOW FLOODING (AO ZONES). <br /> Located within the areas of special flood hazard established in Article 3, Section B, are areas designated <br /> as shallow flooding. These areas have special flood hazards associated with base flood depths of one (1) <br /> to three (3) feet where a clearly defined channel does not exist and where the path of flooding is <br /> unpredictable and indeterminate. The following provisions shall apply within such areas: <br /> (1) All new construction and substantial improvements of residential structures shall have the lowest <br /> floor,including basement,elevated to the depth number specified on the Flood Insurance Rate Map, <br /> in feet, above the highest adjacent grade. If no depth number is specified, the lowest floor, <br /> including basement, shall be elevated at least two (2) feet above the highest adjacent grade. <br /> (2) All new construction and substantial improvements of non-residential structures shall- <br /> (a) have the lowest floor,including basement,elevated to the depth number specified on the Flood <br /> Insurance Rate Map, in feet, above the highest adjacent grade. If no depth number is <br /> speed,the lowest floor,including basement,shall be elevated at least two(2)feet above the <br /> highest adjacent grade; or, <br /> (b) be completely floodproofed together with attendant utility and sanitary facilities to or above <br /> that level so that any space below that level is watertight with walls substantially impermeable <br /> to the passage of water and with structural components having the capability of resisting <br /> hydrostatic and hydrodynamic loads and effects of buoyancy. <br /> ARTICLE 6. LEGAL STATUS PROVISIONS <br /> SECTION A. EFFECT ON RIGHTS AND LIABILITIES UNDER THE EXISTING FLOOD <br /> DAMAGE PREVENTION ORDINANCE. <br /> This Ordinance in part comes forward by re-enactment of some of the provisions of the flood damage <br /> prevention ordinance enacted March 2, 1981 as amended,and it is the intention to re-enact and continue <br /> to enforce without interruption of such existing provisions, so that all rights and liabilities that have <br /> accrued thereunder are reserved and may be enforced The enactment of this ordinance shall not affect <br /> any action, suit or proceeding instituted or pending. All provisions of the flood damage prevention <br /> ordinance of Orange County enacted on March 2, 1981, as amended, which are not reenacted herein are <br /> repealed <br /> SECTION B. EFFECT UPON OUTSTANDING BUILDING PERMITS. <br /> Nothing herein contained shall require any change in the plans,construction,size or designated use of any <br /> building, structure or part thereof for which a building permit has been granted by the Chief Building <br /> Inspector or his authorized agents before the time of passage of this ordinance; provided, however, that <br /> when construction is not begun under such outstanding permit within a period of sixty (60) days <br /> subsequent to passage of this ordinance,construction or use shall be in conformity with the provisions of <br /> this ordinance. <br /> 16 <br />
