DC p
67
AGENDA ITEM #9: MATTERS HEARD AT PUBLIC SEARING (11/30/94)
a. I-40/01d NC 86 Economic Development District
Presentation by Marvin Collins.
This item is to consider an amendment to the
I-40/Old NC Highway 86 Economic Development District
(EDD) to include the area on the west side of NC 86
between Cates Creek and Oakdale Drive.
On January 17, 1995, the Board of Commissioners
approved a 720-acre EDD in the vicinity of the
I-40/Old NC 86 interchange. The initial approval of
the EDD did not include a strip on the west side of
NC 86 between Cates Creek and Oakdale Drive,
containing approximately 24 acres adjacent to
Cornwallis Hills Subdivision.
The owners of the property adjacent to NC 86 had
asked that the land within this strip be included in
the EDD, since the property was considered unsuited
for residential use. The Cornwallis Hills property
owners were concerned with the possible impacts of
non-residential use, particularly on those lots
adjacent to the EDD.
Several meetings were held by the Cornwallis Hills
homeowners and the NC 86 property owners. On January
11, 1995, representatives from both groups met with
the Planning Director and the Economic Development
Director in an attempt to develop an acceptable
compromise. Although there was agreement on some
points, a compromise solution was not reached.
Both groups generally agreed that the properties
along NC 86 should be included in the EDD. However,
there was not agreement concerning the permitted
uses. Cornwallis Hills residents favored designation
of the area as Secondary Development Area. The NC 86
property owners favored designation of the area as
Primary I Development Area.
Insomuch as the affected property owners were unable
to derive a solution, the Planning Staff recommends
that the area north of Cates Creek be included in
the EDD as Primary Development Area, subject to
overlay standards (Primary Transition Overlay Area)
which apply additional restrictions to minimize
impacts on adjacent residential areas. The strip
along NC 86 was advertised as Primary I area for the
November 30, 1994 public hearing. Discussions with
the County Attorney have indicated that the use of
an overlay approach would not require a new public
