2 <br /> restrictions to minimize impacts on adjacent residential areas. The strip along NC 86 was <br /> considered for a Primary I area designation at the November 31, 1994 public hearing. Discussions <br /> with the County Attorney have indicated that the use of an overlay approach would not require <br /> a new public hearing. The creation of an entirely new zoning district (for example, Primary III) <br /> would require that the proposal be re-advertised and presented at a new public hearing. <br /> The proposed Primary Transition Overlay Area was considered by the Planning Board at its June <br /> 19, 1995 meeting. Residents of the Old NC 86 area as well as Cornwallis Hills Subdivision were <br /> given an opportunity to voice their opinions concerning the proposed overlay approach. Following <br /> citizen comment,the Planning Board compared each,permitted use proposed in Primary Transition <br /> Overlay Area with those allowed in a Secondary Development Area(as preferred by the Cornwallis <br /> Hills residents). The Planning Board supported the Primary Transition Overlay approach and <br /> voted on each questionable use.The Planning Board's list of recommended uses as well as the vote <br /> on specific uses is shown on the following attachment. <br /> The proposed Primary Transition Overlay Area as recommended by the Planning Board is <br /> described in the attached revisions to the Economic Development Districts Design Manual text and <br /> permitted use table and includes: <br /> • Exclusion of the following permitted uses: <br /> - manufacturing and wholesale trade <br /> - kennels <br /> - parking as principal use <br /> - nightclubs, bars, and pubs <br /> - restaurants <br /> - retail trade in freestanding building <br /> - research facilities <br /> - places of assembly (less than 300 person capacity) <br /> - hotels/motels <br /> • Limit on the hours of operation for any permitted non-residential use permitted to the <br /> hours between 6:00 am. and 11:00 p.m. <br /> RECOAUdENDATION: The Administration recommends approval of the proposed Primary Transition Overlay <br /> Area,including the Table of Permitted Uses as recommended by the Planning Board and <br /> limitation on hours of operation. <br /> The proposal does not address any requested boundary or design standard changes.Such <br /> revisions would require a new public hearing(August,1995)and have been referred to the <br /> Ordinance Review Committee for consideration and recommendation. <br />
