designated to remain in the vicinity of the operations and barricade all walks, roads, and <br />areas as necessary to keep the public away from the construction. <br />7.17 The Contractor shall provide cover and/or protect all portions of the Work and provide all <br />materials necessary to protect the Work whether performed by the Contractor or any of the <br />Subcontractors or sub-subcontractors. Any Work damaged through the lack of proper <br />protection, or from any other cause, shall be repaired or replaced without extra cost to the <br />CMAR or extension to the Contract Time. <br />The Contractor shall maintain the Work during construction and until the Work is accepted. <br />This maintenance shall constitute continuous and effective effort prosecuted day by day, <br />with adequate equipment and forces so that the Work is maintained in satisfactory <br />condition at all times. All costs of maintenance shall be included in the Contract Price and <br />the Contractor will not be paid an additional amount for such effort. Should the CMAR <br />observe that the Contractor at any time has failed to maintain the Work as provided herein, <br />the CMAR may immediately notify the Contractor of such non-compliance. Such notification <br />shall specify a reasonable time within which the Contractor shall be required to remedy <br />such unsatisfactory maintenance condition. Should the Contractor fail to properly respond <br />to the CMAR's notification, the CMAR may, at the Contractor's expense, take such action <br />as it may deem appropriate to remedy the defective maintenance, including suspension of <br />the Contractor's Work or any part thereof. Any such expense incurred by the CMAR shall <br />be deducted from monies due or to become due the Contractor. <br />Parking lots, streets, and walks connecting to the Project area shall at all times be <br />protected by the Contractor from deposits of mud, sand, stone, litter, or debris in any form. <br />Pedestrian traffic areas around the construction limits must be maintained in a clean and <br />safe condition at all times with required barricades and covered walkways. When <br />excavation or other operations outside the Project limits is required, the Contractor shall, <br />immediately following that work, return the area to its original condition. <br />All catch basins and storm drain lines in the vicinity of the Project site shall be protected at <br />all times from entry of dirt, rubble and other debris. The residue from the cleaning of trucks, <br />wheelbarrows, concrete buggies, etc. must be prevented from entering the drainage <br />system, and if cleaning is done, the residue must be contained and removed from the <br />Project site with other refuse. <br />7.18 No burning of refuse or debris shall be allowed inside or around the Project during the <br />course of construction. <br />7.19 The Contractor shall provide for and maintain necessary safety measures and safety <br />programs for the protection of its employees and other persons at the Project site, and shall <br />comply at all times with the requirements of the most current edition of the CAGC Safety <br />and Health Manual [or the AGC Accident Prevention Manual in Construction], or the <br />equivalent requirements of the Contractor's safety program, and shall fully comply with all <br />Federal, State, and local laws, rules, regulations, and building code requirements so as to <br />prevent accidents or injuries to persons on or about the Project site. The Contractor shall <br />clearly mark or post signs warning of existing hazards, and shall barricade excavations, <br />elevator shafts, stairways, floor and wall openings and similar hazards. The Contractor <br />shall protect against damage or injury resulting from falling materials, and shall maintain all <br />protective devices and signs throughout the progress of the Work. <br />All trenches, excavations, or other hazards in the vicinity of the Work shall be well <br />barricaded, and properly lighted at night. When Work requires closing of an area normally <br />used by the Owner or the public, the Contractor shall furnish, erect, and maintain temporary <br />GENERAL CONDITIONS FOR CM AT RISK PROJECT 21 of 42 JUNE 2007 EDITION
