Chapel Hill ETJ & JPA Areas <br />PUBLIC HEARING: (Y /N) No <br />INFORMATION CONTACT: <br />Craig Benedict, Planning, 919 - 245 -2592 <br />Bonnie Hammersley, Manager, <br />4 yRIbz &IPA911I67 <br />John Roberts, Attorney, 919 - 245 -2318 <br />PURPOSE: To act on the request of the Town of Chapel Hill to extend its ETJ. <br />BACKGROUND: Orange County is in receipt of a request by the Town of Chapel Hill to <br />extend its extraterritorial jurisdiction (ETJ) into an area presently within the Joint Planning Area <br />(JPA) Agreement originally signed in 1987. There is no formal County policy for the expansion <br />of municipal ETJ limits; in any event, the Board of County Commissioners shall receive public <br />comments and concerns tonight. Following the public comment period, the Board will review <br />the information from the Town of Chapel Hill meetings and the current public comment, taking <br />into consideration germane information and take action on the request. <br />The Town of Chapel Hill's request is to extend the existing ETJ westward and northward to <br />include approximately 1033 acres as shown in Attachment 1. These lands were within the <br />Joint Planning Agreement (JPA) since 1987 and the Town of Chapel Hill had prescribed land <br />use and zoning powers per the Orange County /Chapel Hill /Carrboro JPA. <br />Attachment 1 contains a legal description and map of the proposed ETJ extension request and <br />an ordinance from the Town of Chapel Hill Town Council requesting the proposed ETJ <br />extension. <br />Attachment 2 contains a letter from the Town's Mayor, an overview and summary of the <br />request prepared by the Town of Chapel Hill, and petitions and letters from area residents. <br />Attachment 3 — The public hearing was advertised in the Chapel Hill Herald and mailed notice <br />was sent to the affected property owners within the extension area by the Town of Chapel Hill. <br />
