• A Planning Board member wanted to establish a minimum and <br />maximum timeframe for the notification of a NIM and the scheduling <br />of a public hearing. The concern was the NIM could be held and <br />then an applicant delay the scheduling of a hearing thereby limiting <br />participation of adjacent property owners in the review process due <br />to the delay. <br />STAFF COMMENT: As written a NIM is held 45 days prior to the <br />public hearing where an item is scheduled to be heard. <br />There is not a major delay with respect to the holding of the <br />neighborhood meeting and the review of an application at the public <br />hearing. <br />Staff would argue that if an applicant requests a delay in the review <br />of a SUP application (i.e. moving the project from the February to <br />November quarterly public hearings) a second NIM would be <br />required in advance of the new hearing date. <br />After review the Board voted unanimously to recommend approval of the text <br />amendment as presented. A copy of the approved minutes can be found <br />in Attachment 4. A signed statement of consistency indicating the proposed <br />amendment is consistent with the adopted Comprehensive Plan is contained <br />within Attachment 5. <br />November 18, 2014 - Receive Planning Board recommendation. <br />d.
