114
2
applicant advised Staff that the building is located
on the lot line between the NC-2 zoning lot and the
adjacent 1-acre parcel under the same ownership.
The adjacent lot is currently zoned Agricultural
Residential (AR) and Little River Protected Watershed.
It is also included in a lease agreement between the
land owner and Orange County for a solid waste
convenience center. The facility is located near
Walnut Grove Church Road.
Neighborhood Commercial zoning would have been
applied to the 1.0-acre lot when the township was
zoned, if Staff had known the actual location of the
building. Provided the Planning Board and the County
Commissioners find in the affirmative, the Zoning
Officer recommends approval of the request.
No decision on the application is made by either the
Planning Board or Board of Commissioners at the public
hearing. Instead, the Planning Board has 60 days
within which to prepare and submit a recommendation to
the Board of Commissioners. Failure of the Planning
Board to submit a recommendation within the .required
time shall be considered a favorable recommendation,
without conditions.
Administration Recommendation
The Administration recommends that the proposed Zoning
